CITY OF SAN JOSE DECLARES WAR ON COLLECTIVE BARGAINING

The San Jose City Council flagrantly violated collective bargaining rights when it imposed economic sanctions on AFSCME members at its most recent meeting.The Municipal Employees Federation and Confidential Employees Federation chapters of Local 101 have attempted to bargain in good faith two years with the City, offering remedies to the budget shortfall and agreeing to concessions. The City repeatedly refused to consider our offers, and failed to produce counterproposals, instead invoking mediation in an effort to sprint toward imposition of cuts to salaries and benefits. In a stunning conclusion to this one-sided process, on May 31st the City Council voted to impose an agreement on our bargaining units. This is not motivated by the City’s budget woes, it is motivated by a desire to undercut labor. Only three council members had the courage to stand up for union negotiations.

Under Mayor Reed’s direction, the City Management was never committed to bargaining this contract. Instead, the City was on a single path to deprive union members of their rightful voice in determining their wages and working conditions. As if this was not enough, the Mayor continues his effort to declare a “Fiscal State of Emergency” thereby justifying dismantling of retirement benefits for current and prospective city employees.

While the Union is determining the appropriate legal and administrative appeals to pursue, we are using all our might and determination to continue to put pressure on City Council members to reconsider their anti-union stance.
